Abstract

A critical study of the overall scenario of the regulation of the economic, technical, organizational and productive causes with regards to the collective and objective dismissal as articulated in the Spanish labor law. The labor legislator must suggest a redefinition of the industrial relations model: the reassessment of this model cannot be based on a set of rules prone to flexibility. We consider the problems of the conceptual indetermination, the margin of discretion in the law, the regularity of an exclusive limiting tool and the reasonableness of the dismissal, that not only affects the employer, but also the legal operator that must subsume the law in the conflict. The system builds on a model of cost competitiveness where the economic and societal rationality dominates. We deduce that allliberalization reforms have the tendency and the purpose of transforming labor law into a law of labor economics.
