Abstract

This dissertation deals with the configuration of the right to social security as a fundamental human right, which involves approaching its ethical justification, analyzing the question of the determination and protection of basic human needs, to proceed to examine the juridification of moral duty of solidarity through the different forms of public intervention that assume the same, of which the most perfect until now is the institution of Social Security. Also, the examination of the ethical basis of the right to Social Security entails the study of its ethical content, which has been detailed through the formulation of a series of principles that should be respected by any legal regulation that is made of such right. Such principles are those of subjective universality, objective integrity, uniformity of the social benefits, economic solidarity, public management, non-regression and citizen co-responsibility.
