Abstract
The thesis analyses the extent to which the European Union can regulate or influence the mortgage enforcement processes in the different Member States. The first chapter studies the legal bases contained in the Union law treaties for legislating in civil procedural law through judicial cooperation in civil matters, the establishment and functioning of the internal market and the flexibility clause. The second chapter analyses the legal bases that may have an impact on real estate rights. The third chapter examines the legislative development of the proposals aimed at harmonising mortgages and in particular Directive 2014/17. The work concludes with an examination of a legislative proposal de lege ferenda, namely the Proposal for a Directive on credit servicers, credit purchasers and the recovery of collateral of 14 March 2018.
