Resumo

With no sistemacity, the European Union law is creating a system of previous judicial administrative review. To the implementation of European Union law by administrative agencies is where this mechanism is being consolidated. In this regard, some of the most important European agencies have created specialized bodies, also known as board of appeal. These board of appeals acts with objetivity and independance and can review the previous decision of the competent agency according to questions of legality or simple opportunity. This is a succesful model because the decisions of these boards of appeals are recognized by stakeholders as effective resolutions and satisfy their claims in terms of money without recall to the European Union Court of Justice. As the administrative procedure is doing, it is necessary that European Union standardizes the most basic rules of this emerging review of the European administrative action.
