El concepto de acoso en el derecho de la Unión Europea

Resumen

El acoso es una categoría jurídica relativamente novedosa que se incorpora en el marco de la UE a partir de la década de los años ochenta y es objeto, desde entonces, de un continuo proceso de definición y reformulación. Ese proceso se inicia con la adopción de algunos actos normativos del Consejo y de la Comisión que introducen una concepción amplia y poco precisa del acoso. El concepto normativo de acoso se define a partir del 2000 por una doble vía: por una parte, las directivas europeas establecen un concepto de acoso y otro de acoso sexual; y, por otra parte, la normativa sobre funcionarios y agentes ofrece un concepto de acoso psicológico y otro de acoso sexual. La definición jurisprudencial ha conducido hacia una progresiva objetivación de la noción de acoso y hacia una interpretación conciliadora de los distintos conceptos normativos. A pesar de ello, la ausencia de un concepto normativo único o uniforme de acoso constituye un serio y grave obstáculo para garantizar una protección jurídica eficaz frente a ese fenómeno.
