La nueva gobernanza económica de la Unión Europea: ¿una auténtica unión económica en formación?

Resumen

La competencia de la Unión Europea sobre el componente económico de la UEM se ha visto transformada como consecuencia de la necesidad de hacer frente a la crisis de 2010. La UE ha adoptado un arsenal de normas de derecho derivado (Six Pack y Two Pack), tratados internacionales entre algunos países de la UE (Tratado MEDE y TECG) y normas de soft law que han hecho de la "unión económica" un ámbito de especial desarrollo dentro de la UE. La supervisión de las políticas económicas y presupuestarias de los Estados se ha diversificado en función de su pertenencia o no a la zona euro y de la situación de sus finanzas públicas, estableciéndose una supervisión reforzada para los países del euro y una supervisión intrusiva para los Estados con asistencia financiera condicionada a la aplicación de programas de ajuste. Las bases jurídicas del derecho originario en el ámbito de la "unión económica" se han agotado y futuros cambios más radicales de la gobernanza económica requerirán una modificación de los tratados. Las instituciones de la UE y los Estados miembros están reflexionando sobre estos cambios y las propuestas que se discuten son de gran interés: derecho de veto de la Comisión sobre los proyectos de presupuestos nacionales; unión fiscal con presupuesto relevante de la UE nutrido con impuestos específicos; emisión conjunta de deuda pública; desarrollo de instituciones específicas para la zona euro; legitimidad y control democrático de la nueva gobernanza económica.
