Resum

The process of radicalization in the context of Islamist terrorism has been analysed from the most varied disciplines. In all of them a series of categories have been defined to describe the level of radicalization of the individuals, starting from the mere sympathizers to the active members of terrorist organizations. Each of these categories is characterized by a series of behaviours (criminal and not criminal) that show the level of radicalization of the individual. Based on this theoretical framework, the aim of this paper is to analyse to what extent the Spanish Courts are aware of this process of radicalization when imposing a sentence for terrorism offenses. To do this, a total of 34 sentences issued by the National High Court between 2013 and 2018 are analysed.
