Abstract
The regulation of the budget under the Constitution of the 2nd Spanish Republic and its differentiation between budget and State budget law means, within the legal context of the constitutionalism in the period between the two world wars, the higher level of ‘rationalisation’ of the parliamentary form of government ever reached. But at the same time, the constitutional regulation itself operates as a ‘limit’ to the ‘rationalisation process of the parliamentarism’ if we take into consideration the blurring of this constitutional distinction in accordance with the practice applied for the adoption of the first State budget law of the 2nd Spanish Republic.
