La Unión Europea y las áreas marinas protegidas en el Océano Antártico a la luz de su práctica y de su jurisprudencia reciente

Resumen

Este estudio analiza la acción exterior de la Unión Europea para la preservación de las áreas marinas protegidas en el Océano Antártico y su articulación jurídica tanto en el marco de las instituciones de la Unión como en el marco de la instituciones creadas por el Tratado Antártico a las que nos referiremos como gobernanza antártica, haciendo especial hincapié en la Comisión para la Conservación de los Recursos Vivos Marinos del Antártico, ya que es en el marco de esta institución donde la Comisión Europea y los Estados miembros han propuesto “la creación de áreas marinas protegidas y (…) de zonas especiales destinadas al estudio científico del espacio marítimo, del cambio climático y del retroceso de las plataformas de hielo”. La sentencia del Tribunal de Justicia de la Unión Europea en los asuntos acumulados C-626/15 y C-659/16 ha puesto de manifiesto el creciente interés que la Unión Europea y sus Estados miembros tienen en las áreas marinas protegidas del Océano Antártico, un interés que ha evolucionado más allá de la protección de los recursos biológicos marinos para profundizar en la protección de la biodiversidad marina de una manera sostenible, y que inspira igualmente su acción exterior. El derecho de participación de los Estados miembros junto a la Unión Europea en el sistema de gobernanza antártica es lo que ha reconocido esta sentencia.
