Abstract

Recently, the Third Chamber of the Spanish Supreme Court (Administrative Litigation) has had a new disagreement with the ECJ in the context of the social rights’ multilevel system of judicial control at the European level, this time, again, with regard to the legal protection that must be provided to the temporary public employees (in this case, civil service staff and statutory personnel), an issue that, as is well known, has led to a particular conflict in the dialogue among the two different jurisdictional orders (national and European) forced to ensure the adequacy of the European member States’ internal norms to the EU Law. Thus, in its judgement of September 24th 2020, it settles the dispute over the abuse in the temporary contract of a interim statutory worker, disregarding the innovative and relevant Luxemburg Court's “Sánchez Ruiz” doctrine.
