Abstract

With regard to the sentences here considered, our third Chamber of the Supreme Court, has recently consider the agreement of the roster system adopted by the Autonomous Communities to provide provisional non University public employs position, with the EU Directive 1999/70. This Supreme Court Disposition, founded on EU Supreme Court bindings, means a new setback on these kind of permissive gaps, so common in our law system, allowing abuse temporality in public jobs. A new Case Law “stopper” in the fighting against this scourge mining our public employment system, hardly challengeable from lasts law resolutions.
