Abstract

The current work pretend to approach to a great and relevant institution in the bankruptcy legislation like the precautionary actions are. In front of an insolvency situation, the dangerous due to the procedural defaults on payment is very relevant and the adoption of the precautionary actions is absolutely necessary to the good end of the bankruptcy. In spite of its relevant, the legislator has not given not only a complete treatment but also a systhematic one, it what complicates its practice application. For this reason, in this work we pretend to systematize the rules that regulate the precautionary actions and overfill the lacunes which exit in the Bankruptcy Law today with the LEC aplications, being that the supletory law. In the same way we will examinate the general request as well to its adoption as to its impugnation and to its removal too.
