Abstract

The authors express their concern about the events happening in many developed countries in which state institutions, through laws or through the courts of Justice, are usurping fundamental rights of citizens, such as: the right to decide about their own lives, the right to hunger strike, to choose where to be buried, about which lives deserve to be lived and which don't, and about the limits of medical treatment. The authors propose that in certain circumstances, when a person is not able to give informed consent, the doctors should be adopting the position of guarantor as the most qualified administrators of the welfare principle, which would be the principle that must be taken into account once the autonomy principle cannot be taken. The authors warn of the danger that science dictatorship, the state, and the individual in his eagerness to control everything could pose for citizens in this modern age.
