Abstract
The Social Chamber of the High Court of Justice of Catalonia has recently issued a pioneering judgment in the recognition of additional compensation to the legally assessed for wrongful dismissal, based on the judgment of diffuse conventionality carried out on our statutory regime ex art. 56 ET and the revised European Social Charter. With regard to this ruling, a critical analysis is made of the use of this interpretative criterion by our ordinary, lower and higher courts, and a reflection on the future of the model of assessed compensation for unjustified dismissals.
