Abstract

This work has been commissioned to carry out an analysis of the role played by the Law of the European Union in relation to the exclusive competence of the States to establish the legal regime of nationality and the status of EU citizen. More specifically, the study focuses on the interpretation and application that the Court of Justice of the European Union makes of the principle of proportionality in Case JY, which deals with the decision made by the Austrian authorities to annul the security of granting the nationality to the interested party, implying the loss of the condition of EU citizen and leaving her in a situation of statelessness.
