Abstract
This paper deals with the study of the IRPH clause, a stipulation that is sometimes declared unfair due to lack of transparency, because banking entities do not provide consumers with appropriate precontractual information. For this purpose, a court decisions analysis is carried out on the area, which examines the application of control of transparency to the IRPH clause, the effects of the nullity of this stipulation and the expandable effect of the control of transparency
