La inteligencia artificial en el control de los flujos migratorios en la Unión Europea. La necesidad de un marco normativo garantista de los derechos fundamentales

Resumen

El uso de las denominadas tecnologías “inteligentes”, en especial de sistemas de Inteligencia artificial, en el control de los movimientos migratorios han supuesto importantes oportunidades y avances que se concretan en el rendimiento y eficacia de estos procedimientos, pero a la vez han introducido graves riesgos de discriminación, de devaluación y violación de los derechos fundamentales de los afectados. Esta situación exige de una especial atención por parte de la sociedad en general y de forma específica por los operadores jurídicos, que han de adoptar un “enfoque humano”, que coloque a la persona y a sus derechos humanos en la centralidad del sistema. Desde esta perspectiva nos planteamos los límites de uso y desarrollo de la inteligencia artificial en la evaluación y escrutinio de las solicitudes de asilo y refugio de la entrada de inmigrantes, así como en las políticas migratorias.
