Abstract

This paper studies the doctrine of the DGRN/DGSJFP regarding the renunciation of any descendant forced heir, instituted as heir or legatee, whom the testator has vulgarly substituted in the will by his own descendants, with special attention to the decision of January 18, 2022. In particular, it analyses whether or not the substitution should be applied when the testator has assigned the renouning forced heir his strict forced share of the inheritance and what role the interpretation of the testator's will plays in this respect.
