Abstract
This study describes the research results on the suicide/work relationship that the author has developed over the last decade. He has participated in the first ruling (ruling of the High Court of Justice of Cantabria of 27 February 2023) that has declared the occupational contingency in respect of the 4,003 suicides recognised in Spain by the statistics in 2021. This is the first precedent in which the labour inspectorate, in response to a prior complaint, and outside the judicial process, declared the occupational contingency of a suicide outside the workplace and proposed a surcharge on benefits due to the absence of an assessment of psychosocial risks and of a response to a serious conflict that arose within the company. The main purpose of the work is to review the outdated existing regulations and propose various specific actions that would allow the classification of suicide as an occupational contingency to be standardised in cases where it is determined by work.
