Abstract
The doctrine emanating from the judgment of the CJEU in Case C-113/22 abounds in the invalidation of positive ac-tions aimed at women to correct the pen-sion inequality, initiated by the STJUE of 12 December 2019, now recognizing the right of men to additional compensation to compen-sate for property and moral damage suffered by gender discrimination with regard to ma-ternity benefits ex art. 60 LGSS.
