Abstract
This study analyzes some current conflicting issues in the business decision to project a substantial modification of working conditions, concluding that the most correct possibility of addressing these problems is in empirical criteria of casuism. Indeed, on the basis of the existing legal uncertainty on the subject, we address the modifications of the conditions of workers in dubious cases in which it is related to the Right of emergency, with more beneficial conditions, with reductions in working hours, possibilities of vacancies, collective agreements, negotiations with the good faith as key element or with the necessary documentation to be provided during the consultation period.
