Abstract
Confirming that the nature of the substantial modification of working conditions derives from the inherent faculty of the managerial and organizational power of the employer as a result of the fact that the employment contract (dependence or functional subordination) enables that power relationship, we enter to analize the «withdrawal» or non-application of the collective agreement and, subsequently, quite conflicting and doubtful points, concluding with some limits not exempt from controversy that must be resolved by the judge in accordance with the appropriate regulatory framework through a choice that may involve contradictory judicial decisions.
