Resumo

A recent phenomenon in international investment law, African regionalism, understood at the dual level of subregionalism and continentalism, is marked by the modernization of investor protection rules and the modulation of investment dispute settlement mechanisms. The established "communitization" of the African investment regime has been followed by a trend towards the "continentalization" of related standards and institutions, against a backdrop of economic integration. This study provides an in-depth analysis of the legal framework for investment established by the RECs and pan-African organizations. Taking an analytical, forward-looking, and comparative approach, prompted by the cacophony observed between the legal instruments adopted on the black continent, the study aims to outline measures likely to contribute to harmony between them. It therefore examines the evolution of international investment law in Africa from a regional perspective, highlighting its imperfections, innovations, and implications.
