Résumé

Jurisprudence and doctrine have made an important effort to configure the limits and contours of the correlation between accusation and judgment, based on fundamental rights of defense, judicial impartiality and accusatory principle; however, this dogmatic construction have been focused to the first instance. But, what happens in the second degree or in cassation? Are the same guarantees applicable? Is there —or should it exist—, a requirement of correlation between the position that the accusations adopt in the appeals phase and the judgment handed down in that proceeding? Are the same fundamentals, principles and rights that justify this correlation in the first degree applicable in the appeal or cassation phase?
